Bitte bedenkt: Der Anime-Flohmarkt ist eine Veranstaltung, auf der hauptsächlich Privatpersonen verkaufen und sie sind in aller Regel nicht so gut mit Wechselgeld ausgestattet, wie professionelle Händler/innen und in den meisten Fällen ist keine Kartenzahlung möglich.

Bringt daher bitte unbedingt Bargeld und insbesondere Münzen und kleine Geldscheine mit!

Auf vergangenen Anime-Flohmärkten haben wir festgestellt, dass zunehmend nicht offiziell lizenzierte Sachen, umgangssprachlich auch Raubkopien genannt, bei uns zum Verkauf angeboten werden. Wir möchten so etwas nicht und nach unseren AGB ist das daher auch klar verboten. Allerdings ist uns auch bewusst, dass nicht jeder die so ausführlich liest und auch viel Halbwissen über die Gesetzeslage im Umlauf ist.
 
Heute möchten wir euch deshalb über ein paar Sachen aufklären und darauf eingehen, wie wir in Zukunft auf dem Anime-Flohmarkt gegen den Verkauf von nicht lizenzierten Artikeln vorgehen werden.
 
 
Was gilt als „Raubkopie“?
 
Das ist schon das erste Missverständnis, denn das Wort taucht in der deutschen Gesetzgebung nicht auf. Stattdessen geht es in erster Linie um sogenannte Urheberrechte und Nutzungsrechte. Wer hat eine Sache erfunden und wem hat der Urheber erlaubt, sie wie zu benutzen? Das sind die beiden zentralen Fragen, auf die es ankommt. Möchte man nun z.B. Merchandise zu einem Anime herstellen, muss man dafür die Nutzungsrechte erhalten. Ein Urheber hat immer automatisch die Nutzungsrechte. Er kann aber einen Teil oder auch alle an jemand anderen abtreten.
 
 
Gibt es viele solcher Verstöße gegen Urheber- und Nutzungsrechte?
 
Ja, es gibt sehr viele. Es werden tagtäglich Produkte hergestellt und verkauft, die gegen die Gesetze verstoßen. Vor allem im Internet, aber auch auf Anime/Manga-Conventions ist es gang und gäbe, dass dort Händler sind, die solche nicht lizenzierten Artikel verkaufen. Viele Veranstalter versuchen dagegen vorzugehen. Es ist aber mitunter sehr schwer, die Sachen zu erkennen.
 
 
Wie ist das dann mit dem Verkauf von Fanarts und anderen Fanprodukten?
 
Auch das ist ein klarer Gesetzesverstoß, wenn eine Person nicht die Nutzungsrechte dafür bekommen hat. Hierbei hält sich hartnäckig das Gerücht, dass es eine rechtliche Grauzone gäbe. Das stimmt aber definitiv nicht. Die Gesetze in Deutschland sind da sehr eindeutig. Es spielt auch keine Rolle, ob z. B. ein Charakter aus einem Manga in einem anderen Stil gezeichnet wurde. Kann das Original identifiziert werden, verstoßt ihr mit dem Verkauf gegen deutsche Gesetze, unabhängig davon, wie hoch euer Eigenanteil an einem Werk ist.
 
 
Aber wieso erlaubt dann Convention X den Verkauf von Fanarts?
 
Das wissen wir auch nicht. Letztendlich kann keine Convention geltende Gesetze umgehen. Wir haben uns dafür entschieden, den Verkauf von Fanarts und anderen Fan-Gegenständen, welche die Rechte Dritter verletzen, nicht zu gestatten. Bitte habt Verständnis dafür!
 
 
Was heißt das für den Anime-Flohmarkt?
 
Wir möchten, dass ihr als Besucher sichergehen könnt, bei uns nicht aus Versehen Raubkopien und dergleichen zu erstehen. Ab dem kommenden Flohmarkt werden wir deshalb vermehrt rumgehen und die Stände kontrollieren. Entdecken wir an einem Stand einen rechtswidrigen Artikel, weisen wir den Verkäufer darauf hin, erklären alles und bitten ihn, den Gegenstand wegzupacken. Sollte er trotz mehrmaliger Aufforderung entsprechende Artikel nicht dauerhaft wegnehmen, sehen wir uns leider gezwungen ein generelles Verkaufsverbot gegen ihn aussprechen.

At past Anime Flea Markets, we ascertained that increasingly unlicensed items, colloquially known as bootlegs, are being offered for sale. We do not want such a thing and according to our GTC this is therefore clearly forbidden. However, we are also aware that not everyone reads it in such detail and that there is also a lot of half-knowledge of the legal situation circulating.

Today, therefore, we would like to inform you about a few things and how we will go about against the sale of unlicensed articles in the future at the Anime Flea Market.

What counts as a „bootleg“?

That is the first misunderstanding, because the word doesn’t appear in German legislation. Instead, it is primarily a question of so-called copyrights and usufructuary rights. Who invented a thing and who allowed the inventor to use it how? These are the two key issues that matter. An originator always automatically has the rights of use. But he cans cede part or all to someone else.

Are there many of such violations of copyright and usufructuary right?

Yes, there are lots. Products that break the law are produced and sold every day. Especially on the Internet, but also at anime/manga conventions, it is common for there to be traders selling such unlicensed articles. Many organizers try to take actions against. But it is sometimes very difficult to recognize the items.

What about the sale of fanart and other fan products?

As well, this is a clear violation of the law if a person hasn’t got the rights of use. In this connection the rumour persists, that there is a legal limbo. This is definitely not true. The laws in Germany are very clear about this. It also doesn't matter if, for example, a character from a manga was drawn in a different style. If the original can be identified, you will be in violation of German laws by selling it, regardless of how much you created by yourself.

But why does Convention X allow the sale of fanarts?

We do not know that either. Ultimately, no convention can negate any laws. We have chosen not to allow the sale of fan art and other fan items that violate the rights of third parties. Please understand!

What does this mean for the Anime Flea Market?

We want you, as a visitor, to be able to make sure you don't accidentally obtain bootlegs and the stuff like that. From the next flea market, we will therefore increasingly go around and control the stands. If we detect an unlicensed article at a stand, we will point it out to the seller, explain everything and ask him to put the item away. If, despite repeated requests, he does not permanently remove such articles, we are unfortunately forced to issue a general ban on sales against him.

Unseren Bring&Buy haben wir in eine Ecke gleich am Eingang hingepackt. Er wird an zwei Seiten von Glaswänden umgeben sein und das lässt sich gut nutzen. Dort werden wir u.a. Figuren und Mangas platzieren. So habt ihr die Möglichkeit, euch die Sachen von ganz Nahem anzusehen, ohne euch dafür die Hälse zu verrenken.
